If you feel as though you need protection from an individual who you have a close relationship with, or have been wrongfully accused of domestic violence, you need a lawyer who understands the law and will stand up for your rights. At my law firm, I have the experience and knowledge necessary to advocate for your best interest.

I am attorney Tracy Miller, and I am an Orange County domestic violence restraining order attorney. I also represent clients throughout Riverside County and Los Angeles County. I am dedicated to helping clients who want to file or those who want to challenge restraining orders through the entire Southern California area.

Filing A Restraining Order — What Do I Need To Know?

Domestic violence restraining orders are available to individuals who believe they are being abused by someone with whom they have a close relationship, including:

If you want to file a domestic violence restraining order, I will assist you in preparing your customized DV-100 (Request for Order), and will work with you directly throughout all points of your case. I can help you file a domestic violence restraining order and advise you of the effects of Criminal Protective Orders (CPO) or Emergency Protective Orders (EPO).

  • Boyfriends, girlfriends, ex-boyfriends, ex-girlfriends
  • Spouses or ex-spouses
  • Parents, children, brothers, sisters, grandparents, grandchildren
  • Cohabitants or former cohabitants

Domestic violence restraining orders may prevent contact between the parties in any way, and may even require the accused to move out of his or her home. The order may be issued for up to five years and thus may also affect child custody and child support. For this reason, it is imperative you seek legal counsel from an experienced attorney.

Defending Criminal Charges And Domestic Violence Restraining Orders

When a restraining order is filed, it will likely be temporary until a “permanent” order is made. You should seek legal help immediately. If you do not seek legal counsel, a “permanent” restraining order may be issued against you, which could last for up to five years. When you retain my services, I will personally help you file a customized DV-120 (Response to Request for Domestic Violence Restraining Order), and do everything within my power to protect your rights and avoid a finding of domestic violence. I understand what is at stake, and will work diligently to provide the best defense and to ensure the repercussions are as minimal as possible.

When criminal charges are filed along with a domestic violence restraining order, much more is at stake. I have significant experience handling cases in both the family law court and criminal courts in Orange County, and will work to make certain your rights are fully protected.

How Do Restraining Orders Affect Child Custody And Support?

California restraining orders may also affect child custody and child support orders. It can limit the amount of time you spend with your children, and you may be required to pay a significant amount of money in child support and/or spousal support. For example, if a restraining order is issued against you in California and you have children, under Family Code Section 3044, the court may presume that you are unfit to have an award of joint legal custody for up to five years and, in many cases, sole legal custody will be granted to the protected parent under the law.

If you do not have a lawyer, your rights will not be fully protected. In my vast experience, I have handled many cases where I have represented clients in defense against an unwanted restraining order. I will work to ensure that your rights are preserved and that custody and support impacts your situation as minimally as possible.

How My Legal Services Stand Out

As an experienced Newport Beach attorney for domestic violence restraining orders, I have worked on cases from all different sides. I have significant experience in working in this field both as a law clerk and as an attorney. My prior experience includes working as a prosecutor in the Domestic Violence Vertical Unit as a Felony Deputy District Attorney, where I received insight into handling restraining order matters from both the prosecution and defendant’s side. I now apply the knowledge I gained as a former domestic violence prosecutor to defend against damaging allegations, criminal charges or help clients find relief through restraining orders.
