Tracy C Miller

FOUNDER and FORMER PROSECUTOR: Tracy C. Miller has been a practicing Attorney for 17 years and is the Founder of Domestic Violence Legal Center®, handling defense and victims’ rights in Criminal and Family Court Domestic Violence cases, as well as Civil Harassment Restraining Order matters (“neighbor vs. neighbor” / “love triangles).” Tracy also handles matters of general Criminal Defense including but not limited to: DUIs, theft/drug crimes, violations of court orders and “expungements.” Tracy is the eldest of 5 siblings, worked part-time during high school, and full-time throughout undergraduate and law school. Prior to working in the public sector, Tracy’s career in law began working as a receptionist in a firm at age 18. She is the first and only in her family to obtain a graduate degree and professional license. Tracy self-funded her entire education.

Tracy is a former Felony Deputy District Attorney. During her tenure at the Riverside County District Attorney’s Office, Tracy prosecuted many criminal cases, including those involving serious felony Domestic Violence charges. Tracy served as President of the South Orange County Bar Association (SOCBA) and provides continuing legal education credits for lawyers. Tracy is also published concerning topics of Domestic Violence, Criminal Matters and Restraining Orders. She is a member of the Orange County Bar Association (OCBA) and participates in its service as a recognized speaker in the Association’s public service “Speakers Bureau,” whose goal is to better educate the public about the legal system and its effects on family violence.

Tracy served as an Adjunct Professor of Law teaching Pre-Trial Criminal Litigation for 2 years, and continues her lecture work as a guest speaker in law school courses regarding Domestic Violence, Restraining Orders and Family Law. Further, on a yearly basis since 2010, Tracy has acted as Moot Court Judge for Law School Competitions. Tracy acts as a guest speaker in various venues and highly recognized institutions.

Tracy’s firm expanded to Northern California by way of her pro-bono work under the Sargent Shriver Civil Counsel Act as embodied in Assembly Bill 590, where Tracy represented a victim as co-counsel with then Supervisor of the Justice and Diversity Center in San Francisco, a 501(c)(3) non-profit program under the Internal Revenue Code. Tracy provides pro-bono and other services to victims in Southern California as well, including shelters such as Laura’s House, Legal Aid Society of Orange County, and WISE Place (Women-Inspired-Supported-Empowered). A recent case of interest[1] was Tracy’s victims’ rights representation in the Criminal Court as a private prosecutor and advocate under Marsy’s Law, representing one of the largest Domestic Violence Shelters Statewide.

[1] People v. S. Marchand, OCSC Case Number 17HF1070:  Tracy represented Laura’s House in this matter under the California Victim’s Bill of Rights Act of 2008 and California Constitution Article I, Section 28(e). Said matter involved a firearm threat against Laura’s House and its employee(s). The victims threatened by Mr. Marchand were heard via over 200+ pages of victim impact statements filed with the Court by Domestic Violence Legal Center® (including electronic data of Mr. Marchand’s criminal conduct). The Orange County District Attorney’s Office also filed impact statements, and the victims testified at sentencing. The Court disallowed Mr. Marchand’s request for a global misdemeanor case disposition and instead, after considering the written and oral victim impact statements, Mr. Marchand pled to a “strike” offense. A Protective Order was issued against Mr. Marchand to make no contact with Laura’s House and he was admonished by the Court that any violation of said order would cause Mr. Marchand to be sent to State Prison.
