By: Criminal Defense Attorney Tracy Catherine Miller, Former Deputy District Attorney and Founder of Female-Owned Law Firm, Domestic Violence Legal Center®
Introducing Attorney Tracy Catherine Miller
Tracy Catherine Miller has been a practicing Attorney for over two decades. She is a Former Deputy District Attorney and the Founder of Domestic Violence Legal Center®. Attorney Miller’s firm handles general criminal defense matters involving DUIs, vandalism, drug, and theft crimes. Her firm also focuses on domestic violence cases from both suspects’ and victims’ points of view.
Domestic Violence Legal Center® also provides representation in the Civil Courts concerning all violence-related and “Bad Behavior” issues, such as those involving neighbor disputes, boundary disputes, cease-and-desist letters, and Civil Harassment Restraining Order (CHRO) matters.
Besides domestic violence, Attorney Miller’s firm handles general criminal defense matters involving crimes such as: DUIs, theft/drug crimes, protective order violations, “expungements,” stalking, embezzlement, money laundering, juvenile crimes, contempt of court fraud, failure to appear, firearms, elder abuse, drug crimes, cybercrimes, AI deepfake defense, and prosecution, amongst others.
Attorney Miller protects and asserts clients’ constitutional rights from day one by handling pre-file/pre-accusatory representation, which occurs after someone is arrested.
Successful “expungement” representation is key to restoring clients to the status of gainfully employed, assists with recovering licensure the status toward continuing proper support of their children, and strengthens the family dynamic post-conviction, and remedial steps have been taken toward self-help. Licensure attorneys are helpful in assessing this status, and her company points clients in the right direction in this regard.
What makes Attorney Miller’s Expertise Unique and Second to None
Precise Analysis in a Complex “Grey Area” of Law
When Domestic Violence Legal Center® focuses on domestic violence cases from both suspects’ and victims’ points of view, an analysis considering both sides is vital to gaining a cohesive case plan designated precisely to suit the best possible outcome for her clients. Attorney Miller recognizes quickly the nuisances of domestic violence cases that can be quite challenging firms. Attorney Miller’s expertise as a former Prosecutor and criminal defense attorney is unique in that, more often than not, she seamlessly provides an accurate assessment concerning the “grey area” unknown or not familiar to most lawyers concerning domestic violence cases. One unique situation arises when alleged victims are charged with crimes. Attorney Miller’s firm astutely handles victims’ rights, which include those involved wrongfully accused in Criminal and Family Law Courts. Attorney Miller’s unique ability to assess matters from different points of view is of great assistance in these difficult, traumatizing cases where the accused need aggressive criminal defense representation, as many are re-victimized by the system when thrust into the Criminal Court.
Firm’s Unique Hybrid Cross-Over Legal Services
Consultant Services Regarding Mitigation
Domestic Violence Legal Center® assists family law attorneys to create a customized mitigation Plan for their clients. This includes Attorney Miller’s assessment of the exposure for their clients in Family and Criminal Courts since any history of Domestic Violence can cause a client to lose custodial rights and adversely effect the amount of spousal support that client will have to pay to an alleged victim.
Professional Associations, Educational Provider and Firm Outreach
Attorney Miller is a former Riverside County Felony Prosecutor. Attorney Miller served as President of the South Orange County Bar Association (SOCBA) and provides continuing legal education credits for lawyers. Attorney Miller is also published on the topic of domestic violence. Attorney Miller is a recognized speaker in the OCBA’s public service “Speakers Bureau.”
Attorney Miller served as an adjunct professor of Law teaching pre-trial Criminal Litigation for 2 years, and on a yearly basis since 2010, Attorney Miller has acted as Moot Court Judge for Law School Competitions.
Attorney Miller’s firm expanded to Northern California by way of her pro-bono work under the Sargent Shriver Civil Counsel Act as embodied in Assembly Bill 590, where Attorney Miller represented a victim seeking a restraining order (who was also a defendant in a criminal case) as co-counsel with the then Supervisor of the Justice and Diversity Center in San Francisco, a 501(c)(3) non-profit program under the Internal Revenue Code. Said case included Domestic Violence Legal Center®’s collaboration with the Cooperative Restraining Order Clinic (CROC), located in Northern California. Attorney Miller has also provided outreach and established confidential ties with shelters in Central California.
A case of interest involves Attorney Miller’s victims’ rights representation in the Criminal Court as a private prosecutor and advocate under Marsy’s Law, representing one of the largest domestic violence shelters statewide, Laura’s House. People v. Merchant, 49 Cal. App. 2d 712, 122 P.2d 158 (1942)[1]

An arrest is not a charge. A police officer is NOT a lawyer or a Judge. A criminal defense lawyer’s power is not a uniform or weapon, but in the briefcase we carry. When you are just arrested and want charges rejected, this service is helpful to clients’ need for Attorney Miller to assert their constitutional defense rights from day one.

[1] People v. Merchant, 49 Cal. App. 2d 712, 122 P.2d 158 (1942). The Court analyzed the sufficiency of evidence required to establish criminal intent under California law. The decision emphasized that for a conviction to stand, the prosecution must prove beyond a reasonable doubt that the defendant acted with the necessary criminal intent, a standard that remains crucial in evaluating similar cases.
