Former Prosecutor: Understands Marsy's Law

What Is Marsy’s Law?

Marsy’s Law originated in California in 2008 and has since been adopted in several states across the U.S. Named after Marsy Nicholas, a victim of homicide, this law seeks to provide constitutional protections for crime victims and their families. Its overarching goal is to ensure that victims are not overlooked or re-traumatized during the criminal justice process.

Key Rights Under Marsy’s Law

Marsy’s Law varies slightly by state, but the core rights typically include:

  1. The Right to Be Informed: Victims have the right to receive timely information about criminal proceedings, including arrests, trials, plea deals, and sentencing.

  2. The Right to Be Heard: Victims can share their input during critical stages of the legal process, such as bail hearings, plea agreements, and sentencing.

  3. The Right to Be Protected: Marsy’s Law provides for measures to protect victims from intimidation, harassment, or harm throughout the legal process.

  4. The Right to Restitution: Victims are entitled to financial compensation for losses directly resulting from the crime.

  5. The Right to Privacy: Victims’ personal information, including addresses and contact details, is safeguarded to ensure their safety and peace of mind.

  6. The Right to Confer with Prosecutors: Victims have the opportunity to communicate with the prosecution team about case developments and their preferences. fORMER PROSECUTOR's balanced perpsective: victims' rights and oc criminal defense attorney

I worked as a Deputy District Attorney, prosecuting criminal cases in Riverside County. I will apply this experience as a prosecutor to anticipate how the prosecution will approach your case and defeat their arguments.
Much of my experience as a Deputy District Attorney was in the Domestic Violence Vertical Unit. Often these matters can be quite complicated and will overlap with issues in a family law matter.

I have a deep understanding of these cases from both the victims’ and criminal defense clients’ perspectives, and I know how to maintain your rights during child custody, visitation and other family law issues. I will work closely with your family law attorney to provide the most effective legal representation tailored to your case and relevant issues.
